Tips for allocating powers to an agent in general power of attorney
Usually the agent who acts on your behalf for managing the assets and property will be vested with normal powers of financial affairs. If you wish, you can include specific powers in the document for which you authorize the agent to act for you. Unless you mention any additional powers for the agent, he or she will not have any authority to act on the issues other than mentioned in the general power of attorney.
Most commonly the following powers can be given to the agent apart from managing your financial matters. The power of changing the domicile to any other state can be given to the agent, where the Medicare rules are more flexible. The agent can be given power to operate the safe deposit lockers. Normally such powers are given to spouses who act as your POA agent.
The agent can be vested with powers of disclaiming any insurance proceedings on behalf of you. He can sign the IRS tax returns and file the returns on behalf of you and further more you can give him power to settle any tax dispute arises in your name. These powers can be included in separate clauses while signing the general power of attorney document.
If the principal is the chairperson of any organization he cannot frequently attend to any court cases and other legal matters. In such cases power can be given to the agent who represents any litigation arising and settle the issue for you. Also he can be given power for dealing with proceedings of health care matters and long term insurance plans. If you feel the agent is the most reliable person, you can also give him extra powers for amending the existing trusts or create fresh trusts on your behalf. Some persons give the agents the power to revoke the document also if situation warrantees.
While drafting the power of attorney deed take enough care before conferring powers to the agent. This is necessary in case the document goes before the court. You can avoid the possibility of the court which can interpret the power as not specific to the issue.
All the above points can be used when designating specific powers to the agent while drafting general power of attorney document.
